Sunnyvale allowed only single family houses on lots of at least one acre, which kept apartments and subsidised housing out of the town entirely. Mary Dews, a Black Dallas woman who could not find anywhere to use her Section 8 certificate here, sued alongside developers who had been refused permits. In 2000 a federal court found the rule discriminatory both in its effect and, from what town officials had said out loud, in its intent. A 2005 settlement committed Sunnyvale to at least 70 low income units, and the town was later held in contempt for failing to deliver them.
