Black Jack incorporates to block an integrated housing project

A church backed group planned Park View Heights, a federally subsidized townhouse development with a half Black board of directors, on land in what was then an unincorporated area. Residents incorporated Black Jack as a city in 1970 and promptly banned any new multifamily building. In 1974 the Eighth Circuit held that the zoning violated the Fair Housing Act, an early ruling that a law can be unlawful for what it does rather than what it says.
