Born to immigrant parents in a Louisville that was tearing itself apart over slavery, he became the lawyer who invented the practice of arguing cases from social fact rather than pure precedent, and then the first Jewish justice of the Supreme Court, over ferocious opposition. He asked to be buried at the law school of his home city, and he is, under the portico, with his wife, back where he started.
